1 Scope of application

These General Terms and Conditions of Sale (GTC) apply to any purchase of products or services made by any natural or legal person (hereinafter referred to as the “client” or “you” depending on the context) from the company Swiss Recycling Metals Sàrl (hereinafter referred to as “Swiss Recycling Metals Sàrl” or “we” depending on the context), via the website www.SwissRecyclingMetals.ch (and all subdomains), or through any other remote communication channel, or physically on site. Swiss Recycling Metals Sàrl is the seller of the products and services.

You acknowledge that all contracts, notifications, information communications, and other types of exchanges conducted electronically comply with legal requirements mandating that such exchanges be made in writing. Any oral agreement concluded between you and us must be confirmed in writing; failing this, it shall be null and void.

Swiss Recycling Metals Sàrl reserves the right to amend these GTC at its sole discretion; the applicable terms are those in force on the website on the date your order is placed.

The authoritative version of the GTC is the French version. The original French-language version shall prevail over any translations into other languages.

2 Special provisions

In addition to these GTC, special provisions apply to certain products or services: our precious metal waste buyback service (dental crowns, electronic waste, medical waste, etc.) is governed by the General Terms and Conditions for the Buyback of Precious Metals.

3 Legal capacity to contract

You must be legally authorized to create a client account (i.e., have reached the legal age of majority, have full legal capacity, and not be under guardianship or trusteeship).

If you reside outside Switzerland, you must verify prior to selling your waste whether your country authorizes export and resale; Swiss Recycling Metals Sàrl cannot be held liable if the seller violates the legislation of a foreign state.

Depending on your place of residence, you may be subject to taxes and reporting obligations. You are required to declare the sale of precious metals. Our company is not responsible for any failure to declare.

We refuse any commercial relationship with persons holding U.S. nationality or residing in the United States of America.

4 Prices

Currencies: displayed prices and invoiced prices: prices shown on our invoices, and by default on our website, are always stated in Swiss francs (CHF). However, prices may be displayed on the website for informational purposes in euros (EUR) or U.S. dollars (USD).

5 No right of withdrawal

In accordance with Swiss law and European law, there is no right of withdrawal when purchasing precious metals, as their price is subject to market fluctuations beyond our control and influence. The consumer’s right to cancel the transaction and recover the sold items therefore does not apply. All purchases are final, with no possibility of return.

6 Warranties and liability

1. Data protection: The confidential and secure processing of your personal and commercial data is guaranteed. Swiss Recycling Metals Sàrl complies with the Swiss Federal Act on Data Protection. To learn more about data security measures, please refer to the “Legal Notice” page.

2. We undertake to exercise all customary professional care in the provision of services offered to the client. However, our liability shall not be incurred in the event of failure to perform contractual obligations due to unforeseen circumstances or force majeure as defined by the case law of the Swiss courts.

7 Governing law and jurisdiction

These General Terms and Conditions of Sale (GTC) are governed by and interpreted in accordance with Swiss law, to the exclusion of Swiss private international law and the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980. Swiss law shall apply to any dispute between you and us.

1. Jurisdiction:

In the event of a dispute arising from these GTC, the courts of Geneva shall have exclusive jurisdiction, subject to appeal to the Swiss Federal Supreme Court.

2. Enforcement of judgments:

Should you refuse to comply with a court decision, this clause stipulates that all costs related to the enforcement of the judgment in Switzerland or abroad shall be borne exclusively by you.

8 Severability clause

If one or more provisions of these GTC are or become invalid or unenforceable under applicable law or by court decision, such provisions shall be enforced to the strict extent permitted by applicable law. All other provisions shall remain valid and fully enforceable.
